أطلقوا سراح سمية ماهر حزيمة !
تطالب المنظمات الموقعة أدناه السلطات المصريَة بإطلاق سراح السجينة السياسيَة سميَة ماهر حزيمة، وذلك بعد مضيَ ما يزيد عن 4 سنوات على إعتقالها.
سمية ماهر حزيمة، تبلغ من العمر ثلاثين عاماً، قضت منهم ما يزيد عن أربعة أعوام داخل محبسها بسجن القناطر.
تذكر بلادي أن قوَات الأمن اعتقلت سميَة من منزلها في مدينة دمنهور، محافظة البحيرة، فجر يوم ١٧ أكتوبر ٢٠١٧ قبل حفل زفافها بأيَام قليلة، بدعوى تورَطها مع آخرين في الاستعانة بمجموعة من بطاقات الهواتف المحمولة المجهولة. وقد أسندت لها النيابة تهمتي “الانضمام إلى جماعة أسست على خلاف أحكام القانون”، و”الاشتراك في سلوك يضرَ البلاد” وذلك في القضية رقم ٩٥٥ لسنة ٢٠١٧ حصر أمن دولة عليا.
منذ لحظة اعتقالها، تعرَضت سمية لجملة من الإنتهاكات والحرمان من حقوقها، تمثلت في تَعرضها للإخفاء القسري لمدة تزيد عن ٧٠ يوماً دون التعرف حتى على أسباب اعتقالها، أو مكان احتجازها، أو حتى ماهية التهم الموجهة إليها. ثم ظهرت بعد ذلك أمام نيابة أمن الدولة العليا حيث وُجهت لها التهم المذكورة أعلاه.
لم يقف الأمر حد ذلك بل تم احتجازها مدة ٦ أشهر كاملة في زنزانة انفرادية مراقبة بالكامل وعلى مدار ال ٢٤ ساعة مما يصعب معه حتى نزع حجابها، كما ظلت سمية محبوسة انفرادياً وممنوعة من حقها في الزيارة أو دخول الأغراض الشخصية طوال مدة الأربع سنوات، وكان عرضها على النيابة يتم بسرية تامة دون معرفة أي من ذويها أو حضور أي من المحامين. أيضا، تم التنكيل بها في سجن القناطر، ونذكَر من ذلك تشريدها إلى عنبر جنائي (عنبر المخدرات)- ثم إعادة حبسها إنفراديَا في مارس 2020.
إضافة لذلك، تدهور حالتها الصحية في السجن، ومنعها من الأدوية رغم حساسية وضعها الصحي جراء إصابتها بإلتهاب القولون ، وارتجاع المريء، والتهاب المفاصل، مما دفع بعائلة سميَة ومنظمات المجتمع المدني للمطالبة بإطلاق سراحها إثر إنتشار فيروس كورونا داخل السجون المصرية سنة 2020. وهو ما مكنتها منه محكمة جنايات القاهرة حين قضت بإخلاء سبيلها بتدابير احترازيَة أواخر ديسمبر 2020، لكنها وبدون إبداء أي أسباب عدلت عن ذلك وقرَرت تجديد حبسها احتياطيَاً ل45 يوماً، وأصبح التجديد أمراً لا مفر منه طوال الأربع سنوات الماضية.
وبتاريخ 25 نوفمبر 2021 قررت نيابة أمن الدولة إحالة القضية بأكملها إلى محكمة الجنايات المختصة، وأسندت لسمية إتهامات “الانضمام إلى جماعة إرهابية وتمويلها بالمعلومات وإذاعة ونشر أخبار كاذبة”.
واليوم لازالت سميَة تقبع داخل السجن بغير سند قانوني واضح، وذلك لأن قرار الإحالة – السابق ذكره – جاء بعد حبسها احتياطياً مدة تزيد عن أربع سنوات، مما يوجب بالضرورة إخلاء سبيلها استناداً إلى تجاوز مدة الحبس الاحتياطي المقررة قانوناً، والمحددة بسنتين فقط !
كل هذه الانتهاكات التي تعاني منها سمية والكثيرات من السجينات السياسات لا تعدو إلا أن تكون ضرباً من ضروب الظلم وعدم الإنصاف، والتي تغذي الشعور العام بالخيبة من أداء النظام القضائي الذي يتوجب عليه حماية حقوق المواطنين/ات، ومحاسبة المتورطين/ات في جميع أشكال الاضطهاد ضد الشعب المصري.
وعليه تطالب بلادي والمنظمات الموقعة أدناه بإطلاق سراح السيدة سمية ماهر حزيمة، وبقية السجينات السياسيات، وضمان شروط المحاكمة العادلة لهن.

Release Somaya Maher Hazima !
The undersigned organizations call on the Egyptian authorities to release the political prisoner Somaya Maher Hazima, more than 4 years after her arrest.
Somaya Maher Hazima, thirty years old, spent more than four years in Al Qanater Prison.
Belady states that the security forces arrested Somaya in her house in Damanhour, Beheira Governorate, at dawn on October 17th, 2017, a few days before her wedding. She was arrested on the grounds of her involvement with others in using a series of unknown SIM cards. The Public Prosecution charged her under case No. 955 for 2017 Supreme State Security for “joining a group founded against the Provisions of Law” and “engagement in a misconduct against the state”.
Since her arrest, Somaya has been subjected to several violations and deprivation of her rights. She was subjected to enforced disappearance for more than 70 days without even knowing the reasons for her arrest, the place of her detention, or even the charges held against her. Later, she appeared before the Supreme State Security Prosecution, where the above-mentioned charges were brought against her.
What is more, she was held for 6 entire months in solitary confinement, completely surveilled for 24 hours, which made it difficult to even remove her veil. Somaya was kept in solitary confinement and denied her right to visitation and her right to bring personal items for four years. Her prosecution was carried out in absolute secrecy without her family’s knowledge, or the lawyers’ presence. Furthermore, she was victimized in Al Qanater Prison, including her alienation in a criminal ward (the drug ward) – and then her imprisonment in solitary confinement in March 2020.
Moreover, her health condition deteriorated in prison and she was prevented from medication despite her critical health condition due to colitis, Gastroesophageal Reflux Disease, and arthritis. This prompted Somaya’s family and civil society organizations to demand her release due to the spread of Covid-19 inside Egyptian prisons in 2020. As a result, Cairo Criminal Court ordered her release with precautionary measures in late December 2020. However, the Court changed its decision without providing reasons and decided to renew her pretrial detention for 45 days. Over the past four years, the renewal of detention became inevitable.
On November 25th, 2021, the State Security Prosecution decided to refer the entire case to the competent criminal court. Somaya was charged with “joining a terrorist group and providing it with information, and broadcasting and spreading false news.”
Somaya is still in prison without a clear legal basis, because the aforementioned referral decision was issued after her pretrial detention duration that exceeded four years. She should be released based on exceeding the legally prescribed pretrial detention duration, which is limited to only two years!
All these violations suffered by Somaya and many other female political prisoners are nothing more than a form of injustice and inequity, which nourishes the public sentiment of frustration with the performance of the judicial system that should protect the citizens’ rights and hold accountable those involved in all forms of oppression against Egyptian people.
Accordingly, Belady and the undersigned organizations demand the release of Ms. Somaya Maher Hazima, and the rest of the female political prisoners, along with the insurance of fair trial requirements.
