أولاً: بيانات القضية
القضية رقم 142 لسنة 2021 جنايات أمن الدولة طوارئ، والمقيدة برقم 5 لسنة 2021 كلي شمال الجيزة، والمعروفة إعلامياً بقضية “أحرار الشام”.
First: Case Data
Case no. 142 of 2021 State Security Emergency Felonies, and Case no. 5 of 2021 in the North Giza Valley, known in the media as the “Ahrar al-Sham” case.
ثانياً: المتهمون في هذه القضية
تتكون القضية من ستة رجال وسيدة واحدة وطفل واحد (أم وابنها) على النحو الآتي:
1- هشام أحمد عبد الرحمن.
2- عبد الرحمن عبد العليم سعيد.
3- محمد عبد الفتاح أحمد.
4- سياف سلامة محمد.
5- رمضان السيد شعبان.
6- رمضان السيد صالح.
7-السيدة/ فاطمة السيد السيد السيد جيد.
8- الطفل/ أحمد ربيع رشاد الدسوقي.
Second: Defendants in this case
The case consists of the following 6 men, one woman, and one child (mother and her son):
1- Hisham Ahmad ‘Abd al-Rahman
2- ‘Abd al-Rahman ‘abd al-’Alim Sa’id
3- Muhammad ‘abd al-Fatah Ahmad
4- Salif Salamah Muhammad
5- Ramadan al-Sayyid Sha’ban
6- Ramadan al-Sayyid Saleh
7- Mrs. Fatimah al-Sayyid al-Sayyid al-Sayyid Jaid
8-Child/ Ahmad Rabiy’a Rashad al-Desouky
ثالثاً: الاتهامات الموجهة للأطفال والسيدات
1- الانضمام لجماعة إرهابية، والاشتراك في اتفاق جنائي الغرض منه ارتكاب جريمة ارهابية؛ بأن اتفقوا على ارتكاب جريمة الالتحاق بجماعة “أحرار الشام الإرهابية” التي يقع مقرها بدولة سوريا وتتخذ من الإرهاب والتدريب العسكري والأساليب القتالية وسائل لتحقيق أغراضها.
2- تم اتهام السيدة فاطمة وحدها بتهمة تمويل جماعة إرهابية، بأن أمدت الجماعة الإرهابية بأموال بقصد استخدامها في ارتكاب جرائم إرهابية.
3- كما تم اتهامها أيضاً بالتحريض على ارتكاب جريمة إرهابية، بأن حرضت -ابنها- الطفل/ أحمد ربيع على ارتكاب جريمة الالتحاق بجماعة مسلحة يقع مقرها خارج مصر، وتتخذ من الإرهاب والتدريب العسكري والأساليب القتالية وسائل لتحقيق أغراضها .
Third: Accusations against women and children
1- Joining a terrorist group and participating in a criminal agreement with the purpose of committing a terrorist crime; that they agreed to commit the crime of joining the “terrorist Ahrar al-Sham” group that is headquarted in Syria and uses terrorism, military training, and combat methods as a means to achieve their goals.
2- Mrs. Fatimah was charged with financing a terrorist group, for providing the terrorist group with funds with the intent of using them to commit terrorist crimes.
3- She was also accused of instigating the commission of a terrorist crime by inciting her son- the child/Ahmad Rabiy’a to commit the crime of joining the armed group whose headquarters are located outside of Egypt, which uses terrorism, military training, and combat methods as a means to achieve its goals.
رابعاً: رحلة القضية من البداية وحتى التصديق
1- تم القبض على المتهمين في شهر مايو 2017, ليتم اخفائهم قسرياً لمدة شهر تقريباً في مقرات الامن الوطني وغيرها من مقرات الاحتجاز الغير قانونية.
2- بعد مرور شهر من القبض على المتهمين -تحديداً في الفترة بين 13-17 يونيو 2017 ظهر المتهمون تباعاً أمام نيابة أمن الدولة طوارئ على ذمة قضية أحرار الشام, وتم توجيه الاتهامات سالفة الذكر.
3- إثر ذلك, قررت نيابة أمن الدولة طوارئ حبس المتهمون على ذمة التحقيقات, على أن يتم تجديد حبسهم وفقاً للمواعيد القانونية المقررة.
4- بعد مرور عام ونصف على حبسهم احتياطياً, تم إخلاء سبيل السيدة وابنها وبعض المتهمين على ذمة القضية سالفة البيان.
5- في عام 2020 تم إحالة قضية أحرار الشام إلى المحكمة المختصة (محكمة جنايات أمن الدولة طوارئ) لنظر القضية وإصدار الحكم.
6- تم التحفظ على السيدة فاطمة وابنها الطفل أحمد ربيع في إحدى الجلسات, وإعادة حبسهم على ذمة القضية سالفة البيان.
7- بتاريخ 24 أغسطس 2021 أصدرت محكمة جنايات أمن الدولة طوارئ, الدائرة الثالثة إرهاب برئاسة المستشار/ محمد كامل عبد الستار أحكامها على المتهمين جميعاً ما بين السجن المؤبد والسجن المشدد, وقد كان الحكم على السيدة وابنها كالاتي:
أ- حكمت المحكمة ببراءة الطفل/ أحمد ربيع رشاد الدسوقي.
ب- حكمت المحكمة على والدة الطفل السيدة/ فاطمة السيد السيد السيد بالسجن المشدد 7 سنوات عما أسند إليها من اتهامات.
8- بتاريخ يناير 2022 تم التصديق على الحكم سالف البيان, من قبل الحاكم العسكري.
Fourth: The cases’ journey from the start to ratification
1- The suspects were arrested in May 2017, and were forcibly hidden for about a month in National Security headquarters and other illegal detention facilities.
2- A month after the arrest of the accused individuals – specifically between June 13-17, 2017, the defendants appeared before the Emergency State Security Prosecution in the Ahrar al-Sham case, and the aforementioned accusations were brought.
3- Subsequently, the State Security Emergency Prosecution decided to detain the accused individuals pending investigations, providing that their detention be renewed in accordance with the established legal dates.
4- After a year and a half of being held in pre-trial detention, the woman, her son, and some of the accused individuals were released pending the case of the aforementioned statement.
5- In 2020, the case of Ahrar al-Sham was referred to the specialty/competent court (Emergency State Security Criminal Court) to consider the case and issue a verdict.
6- Mrs. Fatimah and her son Ahmad Rabiy’a were detained in one of the court sessions and re-imprisoned pending the case of the aforementioned statement.
7- On August 24, 2021, the Emergency State Security Criminal Court, the Third Circuit Terrorism headed by Counselor/ Muhammad Kamel Abdel Sattar, issued its rulings on all the defendants, between life imprisonment and rigorous imprisonment, and the verdict against the woman and her son was as follows:
A- The court acquitted the child / Ahmad Rabiy’a Rashad al-Desouky.
B- The court sentenced the mother of the child, Mrs. Fatima El-Sayed El-Sayed, to 7 years in prison, for the accusations against her.
8- In January 2022, the aforementioned ruling was ratified by the military governor
